Terms of sale

Conditions governing the sale of QUKO hardware, including delivery, withdrawal and the legal guarantee.

1. Who you are buying from

These conditions govern the sale of physical products (the Kosoku sensor, the Quko Live kit and bundles containing them) through the QUKO shop. The seller is QUKO TECH, S.L., with registered office in Spain, whose full identification and contact details appear in the Legal notice. Purchases are governed by Spanish law, in particular Royal Legislative Decree 1/2007 approving the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU), and Act 34/2002 on Information Society Services (LSSICE).

Quko Cloud licences and subscriptions are a separate matter and are governed by the Quko Cloud terms of use. Where a bundle contains both hardware and a licence, these conditions apply to the hardware and those terms apply to the licence.

2. Prices and taxes

Prices are shown in euros. The shop detects your location and displays prices including any VAT applicable to you, so the figure shown is the amount payable. Where EU VAT does not apply to your destination, prices are shown net of it. The full breakdown (net amount, tax and total) together with shipping costs where they apply, is shown before you confirm the order.

For deliveries outside the European Union, import duties, customs charges and local taxes may apply on arrival. These are not included in the price and are payable by the recipient.

3. Placing an order

The contract is formed when we confirm your order by email. Before confirming, you will be shown the products, the total price including tax, the delivery address and the estimated delivery time, and you will be able to correct any errors. We will send confirmation on a durable medium.

4. Delivery

We deliver to the destinations listed at checkout. Estimated delivery times are shown for each destination and are indicative; they run from the date the order is confirmed and paid. Unless a longer period has been agreed, delivery will take place within 30 days of the contract, as required by law.

If we cannot deliver within that period, we will tell you and you may cancel the order and receive a full refund. Risk of loss or damage passes to you when you, or a carrier you appointed yourself, take physical possession of the goods.

5. Right of withdrawal

If you are a consumer, you have the right to withdraw from the purchase of physical goods within 14 calendar days of receiving them, without giving any reason and without penalty. Where an order is delivered in several shipments, the period runs from receipt of the last item.

This right cannot be waived and we do not ask you to waive it. Note that the position is different for Quko Cloud licences: digital content supplied immediately falls under the exception in article 103.m TRLGDCU, and the Cloud checkout asks you to consent to immediate performance and acknowledge the loss of the withdrawal right. That exception applies only to the licence, never to hardware.

To withdraw, tell us by any unequivocal statement (email to contacto@quko.es is sufficient) or use the model withdrawal form in section 9. To meet the deadline it is enough that you send your communication before the 14 days expire.

You must return the goods without undue delay and in any event within 14 days of telling us. You bear the direct cost of returning the goods. You are liable only for any diminished value resulting from handling the goods beyond what is necessary to establish their nature, characteristics and functioning.

We will refund all payments received, including the standard delivery cost, without undue delay and no later than 14 days from the day we are informed of your decision. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them, whichever is earlier. We will refund using the same means of payment you used, at no cost to you.

6. Legal guarantee of conformity

Goods are covered by the legal guarantee of conformity for three (3) years from delivery, in accordance with the TRLGDCU as amended by Act 4/2022. If goods do not conform to the contract, you may require them to be brought into conformity by repair or replacement, or claim a proportionate price reduction or termination of the contract, on the terms set out in law.

Any lack of conformity that becomes apparent within two years of delivery is presumed to have existed at delivery, unless proved otherwise. Claims should be addressed to contacto@quko.es. This guarantee is without prejudice to any additional commercial warranty offered, which will be stated separately.

7. Payment

Accepted payment methods are shown at checkout. Payment is processed by our payment provider; we do not receive or store your full card details at any point.

8. Complaints and dispute resolution

Complaints may be sent to contacto@quko.es and will be answered as promptly as possible. Consumers resident in the European Union may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

These conditions are governed by Spanish law. Where you act as a consumer, nothing in these conditions deprives you of the protection of the mandatory rules of the country in which you are resident.
